The present general terms and conditions of sale define the commercial relationship between the Vendor HAIRVISUAL 8, rue Paul Lorin 49000 Angers, RSC ANGERS 479303786, and the individual Customer. The general sales conditions for professional customers are available on request by email or via the contact page of the online store.
IMPORTANT: Any order placed on the hairvisual.fr online store implies the Customer’s unreserved acceptance of these terms and conditions.
Prices and VAT
The prices indicated in euros on the hairvisual.fr online store, which are taken into account on the invoice, are those in force at the time the order is registered. No subsequent adjustments will be made. Prices include VAT. Postage and packing not included.
However, HAIRVISUAL reserves the right to modify the prices displayed on the website at any time according to the constraints of its suppliers.
Payment methods
Payment for purchases on the hairvisual.fr online store is made at the Customer’s discretion:
– by credit card via E-Transactions from Crédit Agricole: Visa, MasterCard, national or international Carte Bleue issued by any banking institution
– by PayPal: Paypal account or Visa, MasterCard, national or international Carte Bleue issued by any banking institution
– by cheque: payable to HAIRVISUAL, order number on the back of the cheque, to be sent to HAIRVISUAL 8, rue Paul Lorin 49000 Angers.
– by External Transfer (bank transfer from account to account): the customer receives our bank details by e-mail once the order has been validated.
If you choose to pay by cheque or bank transfer, your order will only be processed upon receipt of payment. If HAIRVISUAL does not receive the check or bank transfer within thirty (30) days following the validation of the order, the order will be cancelled.
Order dispatch
IMPORTANT: During the ordering process on the hairvisual.fr online store, it is essential to enter a valid cell phone number in 10-digit format without spaces or hyphens (e.g. 0612345678) in the “phone” field, as well as the building entrance code on the second line of the delivery address information.
Shipping costs are available in the “SHIPPING” section.
All orders placed before 12pm are processed and dispatched on the same day, excluding public holidays and weekends and except for exceptional events (e.g. power cuts, technical bugs, strikes, etc.). Orders placed after 12pm will be dispatched the next working day.
Delivery
Colissimo delivery is handled by Coliposte (La Poste).
The expected delivery time (after shipment) is 2 to 3 working days for Metropolitan France, 4 to 7 working days for European Union countries and 8 to 15 working days for French overseas departments and territories and non-European Union countries.
For certain countries outside the European Union (e.g. Switzerland, Morocco, Canada, etc.), the customer may be required to pay import and customs fees, which may be calculated by the customs authorities of their country in addition to the order price.
For the overseas departments of Guadeloupe, Guyana, Martinique, Mayotte and La Réunion, purchases are subject to dock dues and customs duties.
ATTENTION: The default delivery method on our online store is “Colissimo Domicile with signature”. We remind you that in the case of “Colissimo Domicile” delivery without signature (in a letterbox), if the parcel is considered as delivered by Coliposte, we do not take responsibility for theft or loss of parcels if the delivery option with signature or in a Point Relais has not been chosen by the customer. Only parcels officially lost by Coliposte, or damaged in transit, will be covered. As thefts from mailboxes, particularly in the halls of residences and apartment buildings, are becoming more and more frequent, we strongly recommend that you opt for delivery with signature or to a Point Relais.
Right of withdrawal
In accordance with article L221-18 of the French Consumer Code, the Customer has the right to withdraw from the present contract without giving any reason within fourteen (14) days from the date of receipt of the order.
To exercise the right of withdrawal, the Customer must notify us of his decision to withdraw from the order by means of an unambiguous statement (at the following postal address: HAIRVISUAL 8, rue Paul Lorin 49000 Angers, or by e-mail to hairvisual@hairvisual.net with the following information:

Back
Customers may return products to us provided they are intact and unopened.
If you exercise your right of withdrawal, you will be responsible for the cost of returning the product.

Items will be reimbursed after receipt and verification of the products by the Customer within a maximum of 7 days.
IMPORTANT: For reasons of hygiene, cosmetic products cannot be returned, refunded or exchanged once opened or used.
Mediation

One month later, if the Customer does not obtain satisfaction, in accordance with Articles L.616-1 and R.616-1 of the French Consumer Code, he may contact the mediation body SAS CNPM – MÉDIATION – CONSOMMATION with which HAIRVISUAL has set up a consumer mediation system. Legal warranties
All our products benefit from the legal guarantees of delivery in conformity (Code de la Consommation art. L 217-4 et seq.) and against hidden defects (Code Civil art 1641 et seq.) allowing the consumer to return non-conforming or defective products.
- Code de la Consommation – Article L217-4 : Le vendeur livre un bien conforme au contrat et répond des défauts de conformité existant lors de la délivrance. He is also liable for defects in conformity resulting from the packaging (…)
- Code de la Consommation – Article L217-5: The goods conform to the contract: 1° If they are fit for the purpose usually expected of similar goods and, where applicable : if it corresponds to the description given by the seller and possesses the qualities that the latter has presented to the buyer in the form of a sample or model; if it presents the qualities that a buyer may legitimately expect having regard to public statements made by the seller, by the producer or by his representative, notably in advertising or labelling; 2° Or if it presents the characteristics defined by mutual agreement between the parties or is fit for any special purpose sought by the buyer, brought to the seller’s attention and accepted by the latter.
- Code de la Consommation – Article L217-12: Action resulting from a lack of conformity is barred after two years from delivery of the goods.
- Civil Code – Article 1641: The seller is liable for any hidden defects in the item sold which render it unfit for its intended use, or which impair that use to such an extent that the buyer would not have purchased it, or would have paid a lower price for it, had he been aware of them.
- Code Civil – Article 1648 paragraph 1: The action resulting from redhibitory defects must be brought by the purchaser within two years of the discovery of the defect.
Consumers have a period of two years from the date of delivery of the goods to take action under the legal warranty of conformity, independently of any commercial warranty. In the event of a lack of conformity, the consumer may choose between replacing the product or repairing it, unless the cost of the latter is clearly excessive. Consumers are not required to prove the existence of a lack of conformity for 24 months following delivery of the goods. If the consumer invokes the warranty against hidden defects (art. 1641 of the French Civil Code), he may choose between rescission of the sale or a reduction in the purchase price (art. 1644 of the French Civil Code).
